1. Acceptance of Terms

By accessing or using MurderBoards (murderboards.ai), operated by Elbo Software LLC ("we," "us," "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. You must be at least 18 years old to use MurderBoards.

2. Description of Service

MurderBoards is an AI-powered expert panel review platform. You submit content — text, files, URLs, or images — and receive structured feedback from a panel of AI-generated expert personas through multi-round debates, clash detection, and synthesis.

The service is provided on an "as available" basis. We do not guarantee uninterrupted access or that the service will meet your specific requirements.

3. Accounts

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information when creating your account.
• One account per person.
• You are responsible for all activity that occurs under your account.
• We may suspend or terminate accounts that violate these terms.

4. Expert Simulation Disclaimer

This is the most important section of these terms. The expert personas in MurderBoards are AI-generated simulations. They are not real people. They do not represent the actual opinions, endorsements, or views of any individual, living or dead.

• Personality profiles are built from publicly available information about public figures for purposes of commentary, criticism, and creative expression.
• We do not contact, consult, or interact with the real individuals whose names may appear.
• All "expert opinions" are generated by AI and should never be attributed to or confused with any real person's actual views.
• We make no claim of endorsement by or affiliation with any simulated expert.
• The use of public figure names is for purposes of commentary and creative expression protected under the First Amendment.

The service is for informational and creative purposes only. AI-generated expert reviews do not constitute professional advice of any kind — legal, financial, medical, or otherwise. You are solely responsible for any decisions you make based on AI-generated content.

5. User Content

You retain ownership of all content you submit to MurderBoards. By using the service, you grant us a limited, non-exclusive license to process your content for the purpose of providing the service — specifically, to send it to AI models for analysis, store it in your account, and display it back to you.

You represent that you have the right to submit all content you upload. We are not responsible for the accuracy, completeness, or usefulness of AI-generated responses to your content.

6. Acceptable Use

You agree not to:

• Use MurderBoards for any unlawful purpose
• Submit content that infringes the intellectual property rights of others
• Attempt to reverse-engineer, extract, or copy AI models or prompts
• Interfere with or disrupt the service
• Circumvent usage limits or credit restrictions
• Use the service to develop a competing product
• Scrape or use automated data collection methods
• Submit highly sensitive regulated data (e.g., HIPAA-protected health records, financial account numbers)
• Misrepresent AI-generated expert opinions as actual statements by the real individuals whose names appear in the simulation

7. Subscriptions, Credits & Billing

• Free tier: 200 credits on signup with limited features.
• Paid plans (Standard/Pro): Monthly credit allotments with auto-renewing subscriptions.
• Credits are consumed per debate based on the model tier you select.
• Unused credits do not roll over and reset each billing cycle.
• You may cancel your subscription at any time. Access continues until the end of your current billing period.
• We may change pricing with 30 days' notice.
• Failed payments may result in service suspension.

Refunds

Fees are generally non-refundable. Refund requests are considered on a case-by-case basis. To request a refund, email support@elbosoftware.com.

8. Intellectual Property

Elbo Software LLC owns the MurderBoards service, software, and underlying technology, including all AI prompts, system designs, and branding. You receive a limited, non-exclusive, non-transferable right to use the service during your subscription.

AI-generated review content is provided for your personal use. The underlying models, prompts, and debate pipeline architecture remain our property.

9. Privacy & Data

Your use of MurderBoards is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

You are responsible for maintaining your own backups of content you submit. While we store your data, we do not guarantee data retention in all circumstances (e.g., after account termination).

10. Disclaimer of Warranties

MurderBoards is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The service will be uninterrupted, timely, or error-free
• AI-generated reviews will be accurate, complete, or useful
• The service will meet your specific requirements
• Expert simulations reflect the actual views of any real person

You are solely responsible for evaluating and validating all AI-generated output before relying on it.

11. Limitation of Liability

To the fullest extent permitted by law, Elbo Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the service.

Our maximum aggregate liability for any claims arising from these terms or the service is limited to the amounts you have paid us in the 12 months preceding the claim, or $100 for free accounts, whichever is greater.

12. Indemnification

You agree to defend, indemnify, and hold harmless Elbo Software LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from:

• Your content or your use of the service
• Your violation of these terms
• Your misuse of AI-generated content, including attributing AI-generated opinions to real individuals as if they were genuine statements

13. Dispute Resolution

Before filing any formal claim, you agree to attempt to resolve the dispute informally by contacting us at support@elbosoftware.com. We will attempt to resolve the dispute within 30 days.

If informal resolution fails, any dispute shall be resolved by binding arbitration on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration. Either party may bring claims in small claims court if eligible.

14. Governing Law

These terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. For disputes not subject to arbitration, the courts of Wyoming shall have exclusive jurisdiction.

15. Changes to These Terms

We may update these Terms of Service from time to time. Material changes will be communicated via email or notice within the service. Your continued use of MurderBoards after changes are posted constitutes your acceptance of the updated terms.

16. Force Majeure

Elbo Software LLC shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, internet outages, third-party service failures, or government actions.

17. General Provisions

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and Elbo Software LLC regarding your use of MurderBoards.

You may not assign or transfer these terms without our written consent. We may assign our rights and obligations under these terms in connection with a merger, acquisition, or sale of assets.
